1. Scope of Services
The Contractor agrees to provide the following services as requested by the Customer:
Plumbing HVAC installations and maintenance Heating and cooling repairs Renovations and general mechanical services
Specific services, timelines, and costs will be outlined in a signed work order or estimate before the project begins.
2. Terms of Payment
The Customer agrees to pay for the services as specified in the signed work order or estimate.Deposit: A deposit of 50% of the total project cost is required before the commencement of work.Progress Payments: 25% of the total payment is due upon 60% completion of the project. Final Payment: The remaining balance is due upon 90% completion of the project.Late payments may incur a fee of 5-10% per month or the maximum legal rate.
3. Term and Termination
The Agreement will remain in effect until the completion of the outlined services unless terminated earlier by either party.Either party may terminate this Agreement for any material breach with written notice.The Customer is responsible for payment of completed work and materials at the time of termination.
4. Contractor Responsibilities
Provide services in a professional and timely manner.Ensure that all work complies with local building codes and regulations.Notify the Customer of any unforeseen issues or additional work required outside the initial agreement.
5. Customer Responsibilities
Provide access to the property for service delivery.Communicate promptly with the Contractor regarding approvals or changes.Ensure the site is safe and free of hazards.
6. Changes to Scope of Work
Any additional services or modifications to the initial agreement must be documented in writing and signed by both parties. Changes may affect the project timeline and cost.
7. Warranty
The Contractor provides a limited warranty on materials and labor for 12 months from the date of completion.The warranty does not cover damage caused by misuse, lack of maintenance, or unauthorized repairs.
8. Liability and Indemnification
The Contractor is not liable for delays or damages caused by factors beyond its control, such as weather, acts of God, or third-party interference.The Customer agrees to indemnify and hold harmless the Contractor against any claims, damages, or expenses arising from the Customer’s negligence or misuse of installed systems.
9. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary information shared during the course of this Agreement.
10. Governing Law
This Agreement shall be governed by the laws of the state of Pennsylvania.
11. Entire Agreement
This document constitutes the entire Agreement between the Contractor and the Customer. Any amendments must be made in writing and signed by both parties.
